Mistrial Declared in Bribery Trial of NJ Sen. Menendez

Sen. Mitch McConnell said in a statement Thursday that Menendez had been indicted on numerous federal felonies and his trial shed light on serious accusations of "violating the public's trust as trust as an elected official, as well as potential violations of the Senate's Code of Conduct".

U.S. District Court Judge William H. Walls declared a mistrial after jurors were not able to reach a unanimous verdict during more than 15 hours of deliberations.

Wells, joined by attorneys on both sides, began interviewing jurors in the judge's chambers before making his decision on deliberations. Menendez attorney Abbe Lowell said the jurors sent out a note that said they reviewed all the evidence "slowly and thoroughly and in great detail" but weren't willing to move off their positions. Bob Menendez's trial said for a second time Thursday that they are deadlocked on the counts of the indictment, a strong sign that the case may soon end in a mistrial.

They accused Menendez of pushing officials to help resolve an $8.9 million Medicare billing dispute in Melgen's favor, while the defense team claimed at trial that the senator was focused on the fact that the billing policies at issue were conflicting and the drug companies were enjoying a windfall.

One juror, Evelyn Arroyo-Maultsby, was excused from the trial last week because of a previous engagement.

Prosecutors labeled the 63-year-old lawmaker as the "personal senator" to Florida ophthalmologist, Dr. Salomon Melgen, who is also on trial.

"To those who left me, who abandoned me, in my darkest moment, I forgive you", he said.

Democratic Sen. Bob Menendez's political adviser says that "all things indicate" he will run for re-election next year and an announcement is likely in the "coming weeks".

They argued that Menendez and Melgen have been friends for 20 years and that helping a friend is not the same as corruption, and that Menendez's actions on behalf of a friend are protected by several legal doctrines and precedents. Neither took the witness stand during the 11-week trial, which included more than 55 witnesses, from Federal Bureau of Investigation agents to plane pilots. The two men were charged with about a dozen counts each, including bribery, fraud and conspiracy.

Defense lawyers said there was no corrupt motive behind the friends exchanging gifts and vacationing together. Walls replaced her with an alternate and instructed the jury on Monday morning to start considering the charges all over again.

Defense attorneys also told Walls that they want him to convey to the jury that a deadlock can be an acceptable outcome as well, something they said he did not do in his instructions earlier in the day.
