Dual nationality sees Aussie Deputy PM Barnaby Joyce disqualified

Australia's top court has ruled that the deputy prime minister is disqualified from his seat in parliament because he held dual citizenship when elected.

Mr Joyce admitted the ruling did not come as a complete shock.

Ian who was a former Acting Speaker of the House in the Western Australian Parliament is on the move back to New South Wales and was keen to put his hand up for this by-election.

It's expected he will win after his main challenger, former independent MP Tony Windsor, announced he would not be running.

"We have a majority of members in the House of Representatives, even in the absence of Barnaby Joyce and. we have support from the crossbench", Mr Turnbull said.

"I think it's unlikely the High Court would strike down decisions before these issues arose", the University of NSW Dean of Law told the ABC this morning.

Mr Joyce said it was wrong to claim the Australian Pesticides and Veterinary Medicines Authority move could be exposed to legal challenge, as it was a cabinet decision signed off by the finance minister.

"We won the last election because the National Party didn't go backwards, we actually went forwards".

The saga began for Mr. Joyce in July after media inquiries to his office made him aware he might hold dual citizenship through his father, James Joyce. He said he was unaware of his dual nationality before the election.
