Detroit Woman Sentenced to Jail for Violating Agreement to Vaccinate Son

But Rebecca Bredow is going to jail anyway because she reneged on a deal with her ex-husband to have their 9-year-old son vaccinated. An Oakland County judge noted that Rebecca Bredow agreed to the immunization last November.

Bredow, from the Detroit suburb of Ferndale, said in court on Wednesday: "I am an educated vaccine-choice mother".

"I couldn't bring myself to do it", the mom of two said in court.

Bredow's ex-husband wants their son to receive the vaccinations, but as primary caregiver, Bredow has declined.

"You agreed in a consent order to vaccinate your child, one".

Under Michigan law, parents are legally allowed to not get their kids vaccinated if it conflicts with their personal beliefs.

Barbara Loe Fisher, president of the National Vaccine Information Centre, told the BBC that the federal government doesn't legislate child vaccinations, but they do issue recommendations to states or local school districts.

Bredow said that she and the boy's father made the decision to space out and delay some of the child's vaccines.

The disagreement over whether or not to vaccinate their son landed the case in court.

Child immunisation rates in MI are also among the worst in the U.S., ranking 43rd out of the 50 states, according to Mlive.

The couple separated in 2008, according to ABC News, but they shared parental custody and the father still wanted the boy vaccinated.

If a parent does not comply with a school's vaccination guidelines, the child is not permitted to attend school and the parent can be jailed for the pupil's truancy. Now, he will have temporary custody to take the child to get vaccinated while she goes to jail.

The judge says the boy has two parents and "dad gets a say".
